    Default Can I File I-485 While Working Out of the U.S.

    I am going to take a great job offer that is in a different country. However, my Green Card application is in process. I am applying for EB1A and NIW. My question is that
    [1] if I should stop this process (I just paid my lawyer, not file anything yet) because the process can not be finished once the applicant is not presenting physically in the US,
    [2] or if I chosen to start the process, am I legally allowed to finish this process while working out of the US (in this case, I will move back to the US after I get the GC.)

    Thank you very much. I am at a point planning my career path. Your advice will be appreciated very very much.

    If you have an attorney, why have you not asked him this question?

    It's my understanding that you must physically remain in the US while your Green Card is in process, unless you have received permission from USCIS to travel abroad. As far as I know, that permission is only for short term absences.

    You should really be discussing this with your attorney.
