    Default Joint Lease Over, But Roommate Is Staying

    I signed a joint lease with my roommate. we're both on the lease, both gave 1/2 of the security deposit. Our lease is up 3/1. I am leaving, she plans on staying by herself. The landlord insists I must get the security deposit back from my roommate directly, but she doesn't have the money to pay me back. Isn't the landlord responsible for returning a joint check to both of us, then re-collecting the entire amount from her, since she intends to stay by herself, and I am no longer on the lease?

    Default Problems with Security Deposit

    The landlord appears to be viewing this as a continuation of the existing lease, but with your name removed as a tenant. You are entitled to the return of your share of the deposit if the old lease is terminated and a new lease is entered with just your (then-former) roommate. It's more complicated if the lease does not terminate.
