My question involves an eviction in the state of: Florida
I am trying to proceed with an eviction. My main problem is this... I only have a signature on the month to month agreement from the husband (signed October 10th). In December, the husband and wife divorced and the husband moved out. The wife has avoided me and I have explained to her that a new lease between she and I needto be drawn up. Now, the wife has moved another girl into the unit and as I mentioned, avoids me (won't answer the door) and my phone calls and of course has not paid rent. I have served her (the wife) with a 3 day notice and the 3 days have lapsed. Now, since she didn't sign the agreement, how do I proceed? Does he (the ex-husband) have the right to evict her and her friend since she didn't sign the agreement?
