    Default Respondent to Motion for Revision of Child Support

    My question involves child support in the State of: Oklahoma. When son went to live his dad in Aug 1007, I did get special credit by getting him 121 days per year. Nov 2008 ex lost the motion to review support on basis of me not keeping 15 yo son overnight on Wednesdays, thus failing to abide by the order. It was pro se on my part. My defence was that the child did not want to come then wake early for school, illness, weather and my work responsibilities. I did take him to dinner then back to his dad's house so did incur expense. Some Sunday's his dad came to pick him up when I said he will have to stay until Monday. Having won that, ex has submitted another motion for revision which is set for Feb. stating that the statute says overnight visit is 12 hours and that the child not wanting to stay overnight is irrelavent. If the motion is revised then ordered to pay 200 more in support, I will have a balance of -$60 after paying utilities and mortgage. 0 money for food or incedentials. My ex just bought 250000 home in Feb. and is financially secure. So the question is, do you think the judge will revise his order ? I am so worried. Thank you

    If the facts and laws warrant an increase, it's likely that the Judge will order one. However, no one can really guess what a Judge will do.

    If an increase of $200 will leave you without food money, it sounds like you need to get a second job, or find some way to cut your expenses. Even if an increase is not ordered, you appear to be in a situation where you need to do something anyway about your financial situation.
