    Exclamation I Want to Deny a Paternity Test for My Daughter

    My question involves paternity law for the State of: Ohio
    I was with a guy for a couple of months and got pregnant. He cheated on me so I moved out. I didnt find out I was pregnant till after I was moved out. He only contacted me 2 times the whole time I was pregnant and both times he was drunk. I had my daughter 5 weeks ago and I don't want him to have anything to do with her because he's an alcoholic and smokes crack. I don't want that in mine or her life. He left me a message claiming he's going to petition paternity, can I deny to get the test done for fear of my daughters safety?

    If he petitions, a court will order the test.

    So pretty much I don't have a choice and have to get the test done IF he follows through with the petition?

    correct.

    if a court orders it, you attempting to prevent it will only cause you grief (and maybe a few legal problems)

    That really sucks...seriously. I really don't think he will give up money that he could use to buy crack or alcohol to pay for a DNA test but I wanted to know just in case.

    If or when he takes you to court for visitation (assuming the child is his), be careful how you phrase things. It's not going to build points with the judge to say that you were willing to participate in the baby-making process with him when he was "only" being an alcoholic and smoking crack, but then you decided to leave him because he cheated on you. I'm not exactly sure how one can put a "positive" spin on that, but if the issue should come up remember that the court is going to give as much weight to your choices as to his, so consider carefully before the full out "dad bashing".
