    Default Sponsoring a Current Tourist on EB-3 Visa

    Hello from Maryland,
    I've desperately looked for someone to take care of my mother-a US citizen living in the US- who spoke her language (mom does not speak English) for nearly 2 yrs. Mom has Alzheimers, osteoarthiritis, diabetes, and other ailments.She is also incontinent and needs round the clock care. I finally found someone but she is a tourist in the US whose visa expires in April.
    My questions are:
    1-Can I sponsor her to go from a tourist visa to employment based immigrant visa under EB-3 (unskilled worker who speaks the only language mom understands)?
    2-How long does all this take (considering I need a labor certification from what I understand) and what happens if we don't have a resolution by the time her tourist visa expires in April? Does she have to leave the US? If so, is there a way to petition USCIS that this is a hardship case.... If she has to leave the US, then i'd have to quit work to stay with mom. Currently, I make manage the situation with help of friends but it is not a sustainable one.

    If you're going to try this, I suggest working with a business immigration lawyer.

    This person is working for you while on a tourist visa? That's problematic....

    She is currently not working but I'd like for her to. The problem is that the process seems to be so long and complex that she might have to leave the country--even if she can be legally sponsored. Of course, that defeats my purpose so I wondered if there was a way she can stay here while the process continues. thanks
