Hello from Maryland,
I've desperately looked for someone to take care of my mother-a US citizen living in the US- who spoke her language (mom does not speak English) for nearly 2 yrs. Mom has Alzheimers, osteoarthiritis, diabetes, and other ailments.She is also incontinent and needs round the clock care. I finally found someone but she is a tourist in the US whose visa expires in April.
My questions are:
1-Can I sponsor her to go from a tourist visa to employment based immigrant visa under EB-3 (unskilled worker who speaks the only language mom understands)?
2-How long does all this take (considering I need a labor certification from what I understand) and what happens if we don't have a resolution by the time her tourist visa expires in April? Does she have to leave the US? If so, is there a way to petition USCIS that this is a hardship case.... If she has to leave the US, then i'd have to quit work to stay with mom. Currently, I make manage the situation with help of friends but it is not a sustainable one.
