My question involves criminal law for the state of: I live in California and was recently arrested on a Drunk in Public charge. I was in my driveway at the time that the Cops arrived and I did not step out of the driveway either. I had not been driving at all that day and I had no keys in my hand, yet they were in my pocket; the officer actually reached in to take the keys so I did not grab them at all. I have one point of contention; which is, I was in no way on public property. I was in my driveway and I believe that the state of California can only charge you when you are drunk in PUBLIC. I was in jail for about 8 hours. I did recieve a citation, is this a valid charge on behalf of the state of California? The reason why the police arrived was because it was called in from my house. No neighbors or outside references were involved. When the call was made and also when the police arrived, they did mention it would only be to pick me up until they felt I was sober.
