    Default Waiting on Disability

    Hello,
    I am from TN.
    I hurt my back back in May 2006. Since then I have had 3 back surgeries.
    The last was 2 level fusion in which I am having problems from that surgery.
    Now I applied for disability in Dec 06. Turned down in March 07 appeal in March.
    I got turned down again in Jan 08. Now according to disability I was not turned down then and had to wait until Oct 08 to be turned down again the second time after getting a lawyer in Feb 08.
    Now as of today 1/9/09 I found out my lawyer in longer in the law firm and the firm says they don't know who my attorney is.
    I have no income coming and have already gotten foreclosure on my house.
    My questions are.
    1. Does this get me oiut of thier contract where I can get another lawyer?
    2. Does it take 12 to 24 months to get a court date?
    3. Can something be done when disability claims that they have no proof of my meniere disease, when my regular doctor sent paper work where it is mention 4 or 5 times?

    If you wish to get a different lawyer, go to a new law office. Your new lawyer will advise you about your obligations to your old firm.

    It takes as long as it takes to get a court date, although twelve to twenty-four months seems long.

    You and your lawyer can submit your evidence as part of your case. If there's confusion over what was sent or received, your lawyer can help you deal with that.

    My husband is currently going through the waiting process for disability as well. We filed in July of 2008,it was denied. We appealed in Dec 2008 and was told more than likely that will be denied in about 3-4 months. Then on average 12-18 months to wait for a hearing. I would find a new lawyer and hopefully you have been appealing your claim and not refiling every time.

    All I can say is this system is soooo broken. We are blessed that we can get by without his income,but I know most people lose everything. Average time to get disability can be 2-3 yrs, which is apprehensible.
