    Default Fault for a Snow Pileup

    I'm in Canada.. just want some opinions.

    I was the last car to crash in an 8 car pileup. It was snowing outside and the roads were bad. I could see people ahead of me braking (I didn't know at the time it was due to some cars crashing up ahead). Anyways, I was travelling in the left lane going somewhere around 40-50km an hour. The car ahead of me was braking, and so was I. Then out of the corner of my eye I see the car in the left lane starting to spin. It turns out he had clipped the truck ahead of him, slammed on his brakes and then ending up spinning out into my lane and hitting the car that was ahead of me (who had hit the car in front of him who had hit black ice and spun into the curb). Moving on... so I ended up hitting him as he spun right out into my lane (it ended up being a head-on collision, with him traveling backwards, us both heading south). Just wondering your input on who would be at fault. I can see if I had hit the car that was originally in front of me, that would be my fault as I would have been following to close and without caution. But that didn't happen, I hit someone because they spun into my lane, and interupted my slowing down to avoid the car in front of me. The car I hit spun out from the passing lane into my lane. Thanks for any input.

    Seems to me that if the car you hit entered your lane close enough that it gave you no time to stop then you should be in the clear. If you hit a car that was already in the lane in front of you, even if it spun out or was hit by another car, then you'd be "following too closely".

    You accident sounds like it was very dynamic and complex. It's next to impossible to predict the outcome.
