    Default What Are The Consequences of Driving On a Suspended License Due to a Speeding Ticket

    My question involves criminal law for the state of: Arizona

    Hello,

    This is a complicated issue, please bear with me.

    My boyfriend was cited for speeding in 2006. He then did not appear in court, and did not pay the fines. He then got cited AGAIN for a speeding ticket in 2007, and again did not pay the fines and did not appear in court.

    His license was revoked. But he continued to drive with a suspended license.

    In 2007, he got pulled over for driving with a suspended license, and the cop basically gave him a warning and a ticket.

    Now in 2008, he was supposed to appear in court but again he did not go.

    He had a warrant for his arrest. He was caught driving on the suspended licence in Dec. 2008 again. This time the cop was not as nice and arrested my boyfriend, and towed the car.

    My boyfriend spent a night in jail and then was released.

    He has to appear in court and pay the fines he owed back in 06/07/08.

    Well he was in court yesterday, and he told me that he is on probation for three years now.

    But he can go obtain his driver's license next week. So he is not prohibted from driving - but he is on probation???

    I thought that DWSL was a mideminor and not a criminal offense warranting a probation? Is there something he's not telling me? Please help! Thank you!

    DWLS is a misdemeanor - which IS a criminal offense. He's lucky he only got probation with his record - he could easily have been sent to jail for several months and then gotten probation on TOP of that.

    Note that his DL problems, aside from the initial speeding infraction, stem mostly from giving the court the finger and not showing up when told. This is actually easier to "fix" than license problems due to things like DUI or excessive points where there can be mandatory periods where eligibility to have a license is nixed - but with his types of issues, with enough money to pay off all the fines and fees, it's not unusual for him to be able to get it back.
