My question involves a roommate in the State of: New York
My friend and I are living in a 3 bedroom in NYC. In August we took on a 3rd roommate. She signed the lease and was living there until December when we came home one night and all of her stuff was gone, about a week before our January rent was due. She left a note saying she quit her job (as a teacher, mind you) and had to move out. Turns out, she took the lease we all signed, which was in our living room, with her.
We want to take her to small claims court for the remaining lease (8 months), utilities that she didn't pay, and damages in the apt (paint on the wood floor, etc). What are our rights without the lease? Can our landlord vouch that she was a tenant and he received checks from her?
Can anyone please advise what we might be able to get from her in court, if anything?![]()
