    Default Annulment

    My question involves annulment in the State of: Indiana. I have been married 3 yrs and have found out that my wife's previous marriage the divorce was never finalized. She is currently getting "close" to one of her friends and I feel that she is trying to set me up for a divorce. Here friend has been giving her ideas on how to make me mess up so that she can call the police and have me arrested on what ever they can think of. I was trying to find out what the statue of limitations or in Indiana for an annulment? If that time has passed can alienation of affection be cause for separation?

    Alienation of Affection is not recognized as a cause of action in the state of Indiana.

    If her divorce was never finalized, your marriage is probably not valid. You'd do well to have a sit-down with a local attorney.

    I agree. You are not married if she was not divorced but you need to go to court to have it declared void.
