    Default Is Labor Certification Needed to Extend H2B Status

    As with H-1B matters, DOL approval is required for an alien to obtain an H-2B visa. The DOL will grant a temporary labor certification to the employer to then submit to USCIS.

    My question is, when an employer is seeking to extend a pre-existing H-2B status, is another temporary labor certification required? I know an ETA-750 must be submitted to DOL before an extension can be granted, but what exactly goes on with the labor certification at that point?

    Your employer may apply for re-certification for up to two additional two years with one year extensions. On each new application, your employer must provide reasons justifying the H2B extension request.
