    Default Sexual Harrasment at Work

    My question involves labor and employment law for the state of: Florida

    I was working at a huge corporation and began with a Manager i absolutely loved. He got fired and they issued a new manager. The new manager then sexually harrassed me for two weeks straight. He showed me naked pictures of females in his phones, telling me to flash customers to get move service plans, talked about the size of my chest, the sexual things i should do for my boyfriend for christmas, the sexual acts he committed and enjoyed. Several other employees witnessed this as well. So I told Human Resources. They took me off work during the investigation, and temporarily transferred him out. When i returned to work, the new manager was there, who was a temporary manager, and told me i was out of dress code, and she sent me home. However, I had been within dress code since I began working there, and have never been told I was out of dress code. My hours were cut to less than 16 hours a week, and I was sent home for dress code. After going to the doctors and taking a few days off for stress, they completely took me off the schedule not allowing me to work at all and giving no explaination. However, I was hired as seasonal, but was told I was to become permanent as soon as the season was over. I've gotten no explaination of my release, and no one spoke to me about it. I want to sue, I'm furious for how I was treated, but how do I go about this?

    This is the typical scenario of complainers are put on the CRAP list.

    HR policies about sexual harassment, in my legal experience, are nothing but a CYA program for court and are all for "formality".

    This way when sued the company can show the jury the policy in print and what they have taught thier managers and given them sexual harassment training, blah blah.

    You have an option of initially consulting an attorney who specializes in employment law or filing a complaint with the federal EEOC or parallel state agency.

    Seasonal or not, one can not be discriminated against and released as the facts descibe. Try signing up for unemployment benefits.

    Agree with BOR. Based on your post, this seems pretty blatantly illegal to me. Florida tends to have fairly weak employment-related agencies so I would recommend the EEOC. It is not necessary to consult with an employment attorney beforehand but it's probably not a bad idea to do so anyway.

    Theres so much more to it too, he would pull my hair when i was with customers, flick my back, and when i would get uncomfortable i would put him in his place, then he'd yell at me and send me home. but when i'd allow the sexual harrasment to go on, he let me do anything, and didnt say a word about it. but i was always really uncomfortable. when HR spoke with me they told me there would be absolute zero tolerence for retaliation. well the new manager that was put in, merely switched out stores with the sexual harrasser, and i remember him telling me how good of friends he was with this manager. The company is so corrupt. they do very illegal things, and the district manager know of the ways, but when it comes to anything, he throws everyone under the bus. ive contacted lawyers, and i feel i would have an excellent case, cuz my hours were cut from over 40, to less than 16, my attire, which was before the case, approved by two prior managers, seen by the district && regional manager. it was retaliation.

    i just moved here. i just dont know what the eeoc is? I'm not from here, I moved out here just this past july. I'm all too confused.

    Equal Employment Opportunity Commission. It is a Federal agency whose mandate is to deal with illegal discrimination/harassment in the workplace.

    I would go ahead and contact an employment lawyer as well. The first consultation is free...

    And if this is whom I THINK you are talking about, any decent lawyer will salivate to take this case on contingency.

    ive tryd to contact a lawyer, but lawyers are so hard to get in contact with it seems! i would think they would wanna take it too! and what do you mean who im talking about? lol i dont believe i gave much info on the employer, just in case. but, seriously ida know what to do, who would be best to contact over this. i have alot of stuff on file, and witnesses. One employee even witnessed the manager crying in the bathroom the night i complained! I think if the public knew of this corporation allowing sex predators to continue working and fire the victims, they'd prefer to just settle!

    That is criminal assault. You have an option of still reporting it to police, but they may or may not act quickly on it, if at all, and consider it an internal/civil matter.

    When and if you intend to sue, make sure you advise your attorney of such, as it can be the basis of money damages and also as a strong point of your general cause of action.
