    Default Knowingly Employing an Uninsured Driver

    My question involves business law in the state of: California

    1. Is it illegal for a company to knownly employ an uninsured driver? The company involves driving/legal document couring if it matters. For the sake of argument the uninsured driver is a partner in the corporation. The other parner is the spouse so knowledge of insurance status is assumed.

    2. Is the busisness liable in anyway if the uninsured driver gets into an accident even if the driver is ruled not at fault?

    3. Assume the buissness is also operating with a suspended buissness license if that matters. Are there specific penalties for that?

    If the company has its own insurance for its own vehicles, it would have no reason to be concerned about whether a driver has his own, separate policy.

    Why would the business be liable for an accident caused by somebody else?

    Penalties for operating with an expired business license will depend upon the type of license we're talking about, and who issued it. Obviously, it's not a good idea.
