    Default What Constitutes Distribution

    My question involves criminal law for the state of: New Jersey

    My roommate was selling pot and our place was raided by the police. We were both arrested and charged with distribution. The police found out that people sometimes stopped by to pick things up when my roommate wasn't there and I would give them bags, but I never took any money for it. I was still charged with distribution. Then I was told by someone that just passing a joint to someone you're smoking with could technically be considered "distribution". Is this true?

    Yup, but acting as a drug "mule" certainly qualifies.

    You are screwed.

    You might squirm out of this so don't get discouraged and take some crappy plea deal. What evidence does the state have against you? Distribution just means you make drugs available, just passing a joint qualifies. But that's usually a potential plea deal charge (tacked on so they can bargain with it) When you sell dope it's trafficking or Possession with intent to distribute. You can get a lot of use out of lawyers web pages. Just search something like "New jersey, drug charges, defense"
