    Default Overstayed with F-1 Visa

    Hello all,

Thanks in advance for your advice.

I came to US in 1991 with F-1 (student) visa. In 1993, I went back home for 3 weeks, visiting my family with the same visa, F-1.

In 1994, I was forced to stop my university education on junior year (3rd year) due to financial difficulties. I have tried to finish my university but money has always been the obstacle. I have been illegal since 1994. But, my student visa expired in 1997 as to my I-20.

3 years ago, I met my girlfriend (US citizen) and we have been living together since 2006. We plan to get marry but afraid of deportation, and we don’t have any children for the same reason. My in-law is pushing us to get marry and have kids because both of us are in our 30s.

It has been tough for us emotionally. My initial goal was to save enough money so I can finish my education and go back home. I didn’t know it got drag so long. My bad!

My ideal solution is I can get married and finished my Bachelor's degree without facing deportation. I really don’t want my girlfriend to live in fear.

Any pointers and comments are greatly appreciated. Thank you very much.

    Regards,
    overstayed

If you entered legally, you are eligible to adjust your status based on marriage to a citizen.
