My question involves criminal law for the state of: Ohio
Thanks in advance for your input on this.
One of my out-of-state relatives was arrested for possession of marijuana (about two joints) in Cleveland. He was not in a car when arrested. He's required to appear in a Cleveland court.
From what I've read, this is a minor misdemeanor and the penalty is a $100 or $150 fine, and this will not show up on his record. Is this correct?
Some other relevant info: He's on probation for DUI (Fall, 2007) in the state where he lives. The questions are these:
* Will the DUI record in the other state affect the outcome of this minor misdemeanor in Cleveland? If so, how so?
* Can the Cleveland judge raise this minor misdemeanor to a 4th degree misdemeanor?
* Can the judge suspend his license?
* Will this conviction show up on his record in the other state, and if so, how likely will it be that the other state finds out about this?
