    Default Here on Visa Waiver, Wanting to Marry a U.S. Citizen

    Hey there!

    I'm from Germany and currently in the US (Florida) as a tourist (Visa Waiver).
    I've been here since October 29th, visiting my former host family who I stayed with for a year in 1999/2000 as an exchange student.
    My hostmom was dying of cancer and I came back overhere to spend some more time with her. While being here I started dating a guy who I went to highschool with, we just got back in touch a few weeks before I arrived.
    My hostmom died on November 29th and my boyfriend has been very supportive during this time, which brought us closer together. Yesterday he proposed to me, wanting us to get married while I'm overhere. I definately do wanna marry him, I'm just not sure if it's legal, since I'm not here on a fiancee visa. And even if it is legal, what would be our next step? Appliying for AOS?
    I hope somebody in this forum can help me out! Thanks in advance!

    I'ts legal to marry - the question is whether the USCIS will regard you as having been honest when you entered the country as a tourist. Your choices are to marry, petition to adjust your status on the basis of marriage, then stay in the U.S. until your status is adjusted; marry, return home, and try to come back on a spouse visa; or return home, petition to return on a fiancée visa, and marry when you are approved and return.

    I still don't know what to do, though... I honestly don't wanna go back and wait til the fiancee-visa is approved...

    On what will the USCIS base their decision? How can they know if I've been honest or not?! I mean, it's obvious that I came overhere to spend time with my dying mom.

    Will it make any difference if my boyfriend and I get married in the States or in Germany?
