My question involves criminal law for the state of: Illinois
I was arrested after getting into a pushing/shoving match with my wife. She called the cops, I got arrested. I've plead Not-Guilty, and I know the DA will try to issue a subpoena to my wife before our next court appearance.
1. Can the DA proceed with the trial if my wife is not there to testify, and if the DA does proceed without my wife, what is the likelihood the Judge would convict me (My wife and I have matching written statements of what happened)
2. My lawyer says that they have to issue the subpoena to her in person, face to face. If this does not occur, will my wife get in trouble?
3. My lawyer says the Judge will grant the DA one continuance if they can't issue the subpoena to her. How long does Judge set the continuance? So far it's been about 30 to 45 day intervals every time I have to face the judge. If the judge grants one continuance does he set a really far out date so that it improves the chances of getting the subpoena to my wife?
And no... my wife isn't dodging. She's an active person, comes in and out of the house a lot.
