    Default How to Add Last Name for Son in Florida

    My question involves name change laws in the State of: Florida

    I would like to add my son's fathers last name to his curent last name (mine) how do I go about doing this? Do I need to file with the court? The way his name would be (fathers last name-my last name) He curently has my last name. And paternity has been astablished. Do I need his approval to do this? Thanks (I need all the help I can get)

    Yes, you need the father's permission.

    Do we need to go to court to do this? I don't have any contact with him, just thru his parents. Someone told me I can fill out the paper work and get him to sign the consent in front of a notery. Then what happens?

    Yes, you will need to go to court. You will also need to have him legally served with the name change petition. Yes, he can sign and have it notarized. Then you'd file that with the court and set a hearing date. It will help if you both appear, just in case the Judge questions father's permission.
