My question involves name change laws in the State of: Indiana.
I have a 2 going on 3 year old daughter and when I first found out I was pregnant with her, the "sperm donor" (I prefer to call him), freaked on me and split... I have since then never seen him, nor has my daughter... EVER. However there has been a court order and he IS paying child support. He wants nothing to do with me or my daughter and has made that very clear from the 2 1/2 + years of no response. The only way I am able to get through to him is through court.
Since then I am now married to someone else and have another baby. Me and my son carry my husband's last name (obviously) but my daughter still has my maiden name. It's not a big deal now but eventually she is going to be going to school and learning that her last name is different then the rest of the family's. So before this happens I want to change her last name from MY maiden name to my married name. Her biological "father's" name isn't even on the birth certificate and like I said she has MY maiden last name. I don't speak to S.D and even when I try, I get no response, so will I have to go to court over this and/or have his permission or anything?
Oh and I want to add that "sperm donor" lives in another state on the other side of the country... not sure if this makes a difference or not...
