    Default Water Turned Off by Landlord

    My question involves landlord-tenant law in the State of: Pennsylvania

    My boyfriend and I have a one-year lease on an apartment. The rent is $450 plus $25 for water, sewage, and garbage. Electricity, phone, etc., is paid by us.

    We recently fell behind in rent because my boyfriend lost his job. He is currently waiting for his unemployment benefits. I paid $300 of the rent on time, but the remaining $175 is unpaid. Today the water did not work, so I assume the landlord shut it off. However, he gave no notice and so far has not returned my phone calls. Is this legal, and also, if we decided we wanted to move, would this be good reason to terminate the lease without penalty? We have had several problems with the landlord before and would like to leave. At the end of the first month in the apartment, the landlord slipped a notice under the door that if rent was not paid in three days, we would be evicted. Rent was not due for four days. He also calls my cell phone several times a day during the middle of the month looking for the rent long before it is due, and has not once called the house phone for anything.

    I am sorry to hear of your problem.

    If your landlord wants you out and you want to leave, it would be best to talk to him and come to some kind of agreement, then you both need to sign a letter of agreement so you both can have a good outcome.

    As far as your water being off, did you you call the water company? there may be an outage in your area or the pipes may have frozen.

    It may be best to check out the water problem before going the route of the landlord doing this. He would be a fool to turn off your water even if you are behind on your rent.

    Please clarify this and post what the water problem was all about once you get to the bottom of this.
