    Default Contesting a Ticket for Driving Too Fast for Conditions

    My question involves traffic court in the State of: Washington

    I live in Bellingham and was driving home from Everett (about 70 miles south) 2 weeks ago in the blizzard that hit the Pacific Northwest. I prefer not to drive in snowy/icy conditions because my personal belief is that the safest speed for those conditions is not to drive at all. I have an SUV with snow tires and 4X4 and it handles amazingly in bad conditions. My husband works in Everett and his car got stuck in gear and I had no choice but to drive all the way there and pick him up. Just about everyone was driving less than half the posted speed limit (60mph) except for the crazies. We were on a 4 lane highway and I was in the 2nd farthest lane from the right. Someone behind me came up behind me going pretty fast and since it is commom courtesy to move to the right and allow them to pass I slowed down and tried to gradually change lanes back to the far right. When I was almost completely in the lane my back tire hit that patch of ice that lay on the road untouched because cars don't travel right on the lane markers and my back end started to slight. I was almost at a complete stop but turned sideways. Thinking quickly I decided just to drive straight onto the shoulder instead of try and correct myself and cause someone to smash into us. Once on the shoulder we tried to get back up and out of the ditch. We were on a slight slope so we started to move the snow out from behind our tires. Just then the trooper showed up and was extremely angry and rude and didn't want to listen to anything we had to say and cited us for driving too fast for the conditions. I was too upset to argue, i was still a little shaken up since this was my first accident ever. He kept saying "now, don't you contest this cause that means you are saying you didn't spin out of control, you need to pay or mitigate" What I am contesting is that I was driving too fast for the conditions. He didn't even witness the accident. If I thought i was in the wrong I would just fess up and pay but I don't think I was..Does it seem like I have a chance in court??

    If you were moving so fast that road conditions caused you to spin out, you were driving too fast for those road conditions.

    I cut and pasted my quotes from the Snohomish County District Court website on traffic infractions. The mitagation forms you will need are here:

    Depends on what division your ticket is at. Suspect either Central County (Everett) or North County (Cascade). Snohomish is a big county, I usually get nailed either in Goldbar/Startup or on the I5 near the Wal-Mart and Casino. Two weeks ago was the ticket, Id get the mitigation forms in ASAP, seeing your in Bellingham might help them decide to let you slip in a hearing beyond the normal 15 days. But would not count on it.

    In the mitigation I've seen people let off all together despite what most WA District Courts say about this subject in their FAQ.
