My question involves an eviction in the state of North Carolina. I have been renting my spare room from my town home to a woman since late July. We both had agreed on a 6 month lease, which means she would need to leave the property by Feb 1st if she did not want to renew it. I emailed her the lease in a word document, and she agreed with it but we never actually signed it.
Anyway, in the last 2 months or so she and her boyfriend have been constantly arguing (very loud I might add) and I finally confronted her about it last night. I asked her that she and her boyfriend can not keep arguing every time he comes over. She told me it is none of my business, etc. I told her that very loud arguments and doors being slammed in my town home is my business. She was very defiant about it and still persisted that it is none of my business. She basically made it sound like that she will continue to argue with him at will. She basically gave me no choice and I told her that I’m giving her a 30 day notice to leave after the lease ends. She said we never actually signed a lease, which it is true. Would she then be considered a month by month tenant by default?
She went ahead and told me that she is in the works of finding a new place and that she will move out when she is ready. I could not get a straight answer as to when “she is ready” really means. Is it correct for me to just give her a 30 day notice? Does it have to be written?
