    Default Process to Marrying an Immigrant on a Visa

    Hello, I'm an American citizen in California seeking to marry an immigrant that is here through a student visa. She has been here for several years now. I want to know what steps are required to get married in the United States or more specifically in California. Also, what type of documentations are required to get married to an immigrant. From what I can gather, she'll need a passport or photo ID, her birth certificate and some other things. But I'm not too sure on that.

    Second, after we do get married we plan on living together. Though to live together we both need to work and I'm aware that she is not able to work outside of school legally without applying for other visas or something like that. I understand that the application process can take months, but is there a way to apply to be able to work legally in a quick manner? What are the forms required to enable her to work legally and become a permanent US citizen?

    Getting married in the US. Contact you local county courthouse for the rules regarding documentation. Generally, there are no laws AGAINST marrying someone who is not a citizen or perm resident. Each local county has different requirements for documents. Valid government (any) ID is needed for sure. Some times, a specific county will require a social security number. The law reads that IF you have one, you must provide but some counties interpret that as you MUST have a SSN to get married. If you local county still requires it, check other surrounding counties.

    After Marriage, if she wants to work you would need to start the process to get her permanant residency. Here is a link to the USCIS website with more information on the process.

    In this process, you can also file an I765 application for employment authorization. This will allow her to work legally while you are adjusting status.

    There is also a place on that web site to check processing times...for the I765 in California, it looks to be about 3 months to process and approve that application.
