My question involves criminal law for the state of: Georgia
An illegal alien married to a US citizen, but who never thought he needed to get those legal papers later, got set up in a drug case involving marijuana. He eventually accepted a plea bargain, guilty to the charge of felony possession with intent to distribute, and received a $1000 fine, assorted junk fees and five years probation. His attorney was very hopeful for an acquittal using the entrapment defense, but he did not want to risk being found guilty by a jury and a possible sentence of ten years. He was ordered to attend drug and alcohol classes, AA meetings, do community service, submit to random drug tests, and report for monthly probation meetings. He completed all the above requirements during the first seven months of his probation, then during the holidays when all government offices were closed, a difficult family matter came up and he made the decision to return to his home country.
Of course he was not able to get permission to do this, and three months later an arresting officer showed up at his wife's house with a warrant, but after searching the house and seeing that all his clothes were gone, they have never bothered to come back looking for him, though after three years the warrant is still active. My question is, since he is out of the country and has no legal papers, he is not about to return and face possibly 4+ years in jail. Could the wife arrange with the court to pay off his fine in exchange for their closing the books on his case and recalling any outstanding warrants? They would get their money, and would be able to close a case, but should they not agree, he will never return and they will never see a dime. The wife can always move to his country, as there is little chance that he would ever get legal papers to return here, being a convicted felon. She simply wants to have the case closed and not be subject to a random search in the future as long as she resides here.
Should this be possible, how would the wife negotiate this? Thanks for any advice.
