    Default Terminating a Lease Due to Crime

    My question involves landlord-tenant law in the State of: California
    Do we have a right to terminate our apartment lease? Immediately?
    We have been victims of aggravated assault on successive days at our apartment. Extremely serious situation involving gunfire.
    This was not our fault or our landlord's fault, but we can't stay here. How can we conclude our business with the landlord? We still have 6 months on the lease.

    California statute allows you to terminate your lease based on criminal activity. However, in order to protect yourself from a lawsuit, you should contact an attorney in your area who specializes in landlord-tentant law in your state.

    It must be done correctly, and within the guidelines of the law.

    I agree. Contact the law enforcement agency who is investigating the assaults, and ask if they have a victim advocate on staff. If so, this can be a contact person to get referrals and guidance on exercising an early termination to your lease under the various statutes that make up victim rights protections in your state. If your local law enforcement agency doesn't have such a person on staff, you can try your local DA's office.
