    Default what to do when social services is involved

    What is the process when one is the non custodial parent and the custodial parent has just been assessed by social services and found that there was physical abuse? Does the non custodial parent have to wait for it it go to court before getting custody, and if not how can they get temporary custody or can they?

    Default Protective Services Involvement

    If the children are being removed from the care of the custodial parent, make sure that they are aware of your location and your interest in providing care.

    Depending upon local laws and full facts of your case, you may be able to petition a court for custody pending the resolution of the abuse case, or may be able to petition for a change of custody. Given the complexities, it would be advisable to contact a family law attorney in Iowa to assist with any custody efforts.

    should the non custodial parent wait for the court date set by the social services, or should they take action before that?

    Default Court Dates

    That depends upon how quickly the next court date is scheduled. The parent would be well-served to consult with a lawyer in Iowa in advance of the next court hearing, whether that is initiated by social services or by the parent, in order to determine the best approach to the case and to that court proceeding.
