If you wish to do so, you could try talking to your brother.
If you wish to do so, you could try talking to your brother.
You could also try going to the appointments with his PD (the PD likely does not have time for appointments) and court cases with your brother.
The unfortunate fact is:
1) He was doing a private thing in a public place.
2) The girl was 14 and even if she had a fake ID the law does not allow that as an affirmative defense.
a) This is why it is important to get to know someone before you play with their holiest of holies.
3) He was caught committing this sex act on a 14 year old.
4) His best bet is to let the PD drag this out until their caseload is a little lighter and they have time to fight for a decent deal.
Being caught in the act really reduces the degree to which your brother can negotiate. I would try to get the prosecutor to reduce the charge to a gross misdemeanor and then agree to plead guilty to that. But like I said, Being caught in the act really reduces the ability of the Public Defender to play "Lets Make a Deal".
I say........... That he just file for that discovery motion cause the case is not strong enough and plead NG till the end and play it out.....remember as of right now he is being "detained" from the public because he is guilty until proven innocent by the courts. They don't have shit on him IDC!!! the cop didn't have a great view of the oral sexual relations actually happening and if you ask me the cop was being a perve....just sitting there watching him do it. I mean WTF! Screw that he's innocent unless they drop it to misd. and him not have to register. Which I think this whole registering thing is all screwed up anyway!! When you log onto it, it should tell the public exactly what the charge was!! How do you like my answer??? I think it's the best one yet! I will be his lawyer![]()
