    Default Granparents Rights when the Parent (the Child) is Deceased and Minor Chldren Remain

    My question involves a child custody case from the State of: Virginia
    Sister died this year. No contact with minor children still in home with abusive father. Sister had father arrested on several occaions there is some but vague proof of abuse. What visitation rights do my parents have-we all live in a different state. Can information from schools be given to sister's remaining family members,schools will not speak with us.
    Do we hire a lawyer or go through social services

    Visitation is whomever the children's father wishes them to see. And any information provided to you by the school, doctors, etc. cannot be accomplished unless it is requested by the custodial parent or you can obtain legal guardianship.

    If the state found no case of abuse and the children were left in his custody, you have an uphill battle to prove otherwise. You can consult an attorney on your options but they are few, if any.

    Your parents or any member of the fmaily who ha close ties to the kids can file for visitation. I know someone who was the step mother of a child, she had a sibling of the child and when father was out of picture she was able to get some vistation for her daughter with her brother so they could still be apart of each others lives. It can be done you just have to present your case. Hire a lawyer...that is your best bet and you will have to file in the state the child lives in. They have jurisdiction over the child, but you may be granted some visitation for some summer time or otherwise as you are the last link to their mother. Good Luck!
