    Default Marrying on an H1-B Status

    I am planning to marry my girlfriend who is a Japanese citizen. Now my question is can I marry her here in the U.S. and have her status change as my dependent. I am here on an H1-B working visa and she being a Japanese falls under the Visa Waiver Program. What are the legal implications of this? Thanks and have a merry merry christmas...

    You can marry her and seek H4 status for her, but she shouldn't go out of status - she should not overstay her visa (or visa waiver) while seeking H4 status.

    Thanks for the reply. It's a big help. Another question please if you don't mind - how long does it usually take for H4 visa to be processed?

    Generally speaking, you can expect the processing time for her H4 to be approximately the same as the processing time for your H1.
