    Exclamation I Live in New Jersey - Can I Emancipate Myself

    My question involves emancipation laws for the State of: New Jersey--I have read the forums on the website, and followed the guidelines for other states but, have not had a direct answer which pertains to the State of New Jersey. I have multiple possiblites of residence including my Grandmother, a friends home, and my father, but currently by my mothers authority I still "legally" reside within her residence (although I do not shower, eat, etc. within the home). I have obtained and held a job for the past 7 months, and am finacially independent, and stable. I maintain an 88% g.p.a. in high school as a Junior, and partake in mutiple extra cirricular activities including: Junior Class Treasurer, Debate Team, and Varsity Wrestling & Track. I am highly disciplined, but come from an abusive background (and presently have a D.Y.F.I.S. case open which has stood for the past 3 years), I do not wish to "divorce" my parent in a negative manner, I only wish to relieve myself of her tyranny because it has proven only to bring further abuse & strife to my life that I do not need. I am no ordinary 16 year old, and I more than well know the diffuculty of the emancipation process but I've been working day in and out for the past 7 months in hopes to be one of the few to rise to the challenge--and so if you have any information to aid me, I would greatly appreciate it.

    Good thing, that, because you couldn't divorce her anyway. Divorce has a very specific meaning - the termination of a marriage.

    Since you claim to have read everything already, you know that New Jersey has no statutory provisions for the emancipation of a minor, therefore, you cannot be emancipated.

    I understand that, hence the use of quotes around the word divorce--I have no time for senseless satire, if you have no useful information please do not post. For those of you who can aid me with the issue at hand, please reply I am in dire need. Thank you.

    Presumably, you speak English?

    If so, then it should be obvious that your question has already been answered for you. Begging for someone else to answer is not going to change the answer in the slightest.

    Let's try this again: New Jersey has no statutory provisions for emancipation of a minor.

    That means: You can't. The law does not allow it.

    Divorce not applying, and emancipation not possible in your state, means that the only two ways out are to either petition your local probate court for a change in guardianship (like to another family member for instance), or, to await any outcome of the CPS case to see if you'll be removed from the home by social services and placed with a foster family or in some supervised group home.
