    Default Child Support Arrears

    My question involves child support in the State of: texas

    The court ordered my ex husband to pay $590 month and all medical insurance coverage until the youngest turns 18. My ex husband did not pay childsupport for nine months and did not pay medical expenses for three years. This is now 12 years later. I recently reported him to the Texas Attorney General and my child support was increased by $276 month. My son is now 16 1/2. Does the state of Texas tack on interest? If so, how can I find out how long my ex husband will be paying on the arrears?

    Texas does tack on interest for sure. From my understanding child support payments go directly towards the principle and not the interest. Interest gets paid last. So if he owes $12,000 in arrears and he's paying you $866 / month then you would be getting support for the next 13 months, then any money he sends in goes to paying off the interest which is private between him and the state. So calculate how much he owes or I'm sure the AG's office can tell you and do the math without figuring in interest.

    Do you know what the percentage is per year? Does both the intial amount and interest come to me?

    Arrears for most states is a 9 to 10 % interest rate.
    as long as you were not on any state aid everything will come to you, if you were then the money owed to the state they will keep.

    any arrears above what a state is owed will come to you.
