Default Can a Vehicle Pass Over the ROW

    Another question:

Our deed states the neighbor has an 8' ROW over a strip of land and this was originally put in the deed in the 1800's. I suppose that means vehicles are allowed to pass over this area? How would you ever know somwthing like this? In the 1800's they probably brought horses over the land???

Thank you to all of you who have been so helpful.

Default Re: Can a Vehicle Pass Over the ROW

A Right-of-way is a right of passage. Doesn't really matter if on foot, horseback, bike or vehicle. It allows the passage through the estate of another.

Some ROWs have limitations specified in the writings, but these are infrequent.
