My question involves criminal law for the state of: Texas
My brother has been incarcerated in Texas for 10 years. He was sentenced to 70 years for aggrivated assault on a law enforcement officer. He was a truck driver and was taking methamphetamines. After selling everything possible he was unable to purchase anymore meth. While coming down from the meth he jackknifed his semi on an interstate in Texas early one morning. By the grace of God no one ran into his rig or got hurt. Someone did inform police and a deputy was dispatched to the scene. The deputy parked his car directly in front of the cab of his truck. According to the deputy my brother was able to get his truck out of the jackknifed position and rammed into his patrol car. My brother and his rig ended up in a field and shots were fired. Once again no one was injured. They apprehended my brother and took him to the hospital to be drug tested, however a phone call was made by someone at the police department and the drug test was never performed. Many things went on at the trial that should not have: jurors were in bible study classes with victim (deputy), prosecuting attorney and defense attorney were in practice together, to name a few. We are not disputing the fact that what he did is wrong but 70 years is a bit steep. I am looking for help in getting his sentenced reduced and him back to Florida with his family. Can anyone provide guidance or advice? I would be happy to divulge other interesting occurances from the trial.
