    Default Retail Fraud, First Time

I was caught shoplifting and I just don't know what to expect. I have a call into an attoney to seek his advice. About a year ago my husband's job transferred him upnorth and it has been pretty tough since then. I know it's not an excuse to do what I did but I went into that store looking for shoes with the intension of buying them and when I seen the summer clothes on sale and new my kids needed them my mind started thinking. I keep bags in my car for when I take my dog to the park or anywhere for that matter in case he has to go to the bathroom and I have something to pick it up. Well I knew on the bags was a bag from the store I was in so I went out and got the bag and put the items into bags and left the store. The came out to my car and wanted me to take the items out of my car and come with them. They said they had me on tape doing this. Of course I was scared so I did. It was a total whim but they made it like I do this all the time because of the empty bags that were in my car for a couple different stores. Of course I said it was for my dog's poop but they didn't believe me.

I've never done this before and after this I will never do it again. I have a clean record, my husband is up north 6 hours away from me because of work and I have two school kids at home with me. I can't go to jail and I'm really worried. The officer didn't take me jail but he said I would need to contact the prosecutors office in a couple of weeks to see if they issue a warrant for my arrest.

I just want to know what to expect. Can my attorney help me take care of things without having to turn myself in? I looked up the different degrees of retrail fraud and I would be classified 2nd degree. Besides the charges from the prosecutors office can the store inself also try to get monetary damages from you? I just looking for what to expect and I now when our lawyer friend calls he can tell me but I am just so upset, embarrassed, so mad at myself. I don't want my kids or anyone to find out about this.

Perhaps. If you have not yet been charged, your lawyer may be able to work out a resolution with the prosecutor's office which would avoid your being charged. That's rarely easy to accomplish, and it something you should discuss with your lawyer.

If the store has suffered monetary damages, it may make a claim for compensation. You suggest that the store recovered its merchandise, and stores are usually content with that outcome.

I have spoken to my attorney and he told me to just sit tight until I get a letter from the prosecutors office and in the mean time he is going to send a letter to them but I think it's just to have all correspondence to to him.

As far as monetary damages by the store - the stores got all their stuff back I didn't get anything. I guess I'll have to sit back and see what happens next. This is definitely a circle of terror I plan on not getting into again. The movie scared straight is oh so truthful - it definitely did the trick on me but then again this wasn't something I usually do it all happened on a whim so it's not like I'd addicted or anything. Experience to remember that is for sure and I just hope two things: 1. the monetary damages are not too bad and 2. No jail time (this one being the most important!)
