Looking for some input on charges my step son faces. He is 20. We live in Virginia. He had 3 misdemeanors ( 2 on phone misuse and 1 on brandishing a firearm) prior to this. He was on 1 year probation (brandishing) when he shot a man 3 times. He is charged with malicious wounding and misuse of a firearm in comission of a felony. I am worried that since he was on probation for 1 year with his sentence on the brandishing conviction suspended for 1 year he faces a stiff sentencing in February '09. I am curious as to any input on what sentence he may face. His mom is totally devastated by this. He turned himself in within hours of the crime. The victim was shot in the hand, ankle & leg. Obviously he was not trying to kill him or he would have aimed at his chest I would think. But, he did hit the femoral artery when he shot him in the leg and he almost bled out. He is doing well now. This all happened in November. Bond has been denied twice. All this happened over a dispute over DVD's. The victim lost control and charged my stepson who had a gun in his pocket. We do have an excellent lawyer. Don't get me wrong, I fully understand he has committed a violent crime and needs to be punished. Any input appreciated.
