My question involves a security deposit in the State of: Wisconsin
I had a verbal month to month agreement with my past landlord after our year lease ended.
In August I had mentioned to my landlord that I was looking for a new apartment. On September 11, 2008 I gave my landlord a written notice that I was leaving and would be gone on September 30, 2008.
Although, I know I was not smart to give 28 day notice, the landlord did not tell me she was withholding the security deposit as last month's rent. Just last night I got a letter from her stating I would not get my security deposit back and that I owed her $285 for cleaning charges that included things like vaccuming and dusting.
In Wisconsin we have a 21 day rule of returning a security deposit to a tenant. Even though I did not give 28 day notice, am I still entitled to my deposit considering she did not write me stating reasons for not returning and cleaning charges?
