Default Is is Illegal to Use The Kitchen Depot

    Hello,

I have started a small business which is called The Kitchen Depot LLC, Our logo's and colors are similar to The Home Depot but not exact.

Our logo is in a different orange than the The Home Depot, also our logo says "The Kitchen Depot" and it is in a rounded square and different font.

The Home Depot is in a Regular Square.

    Our primary focus is Kitchens.

Please let me know if this can become a problem for me later.

If anyone would like to view my website it is: www.thekdepot.com

personally, I believe it is an obvious attempt to confuse a viewer.

The problem for you is; Does Home Depot feel the same way. They have lots of money to throw at things like this so unless you have lots of money to defend yourself, if you are contacted and a demand is made to cease using the name and/or advertising style, I would do it and leave it alone.

It is not an unusual turn of events for a company to simply sue a competitor into bankruptcy.

There is no problem with the name; Office Depot, Home depot, Computer depot, Solar depot, etc. But if at first blush your artwork (especially fonts) looks similar then it might appear to be an attempt to make people think you a division of home depot.

Lawsuits come out of the blue and force you to spend money, better to stay off their radar.
