    Default Generic Support Question

    I have been paying support for 12 years, the child turned 18 very recently.

    I realize that 21 is the age limit in NY which is where she resides, however she has officially dropped out of high school (already left back a grade), is doing drugs and has absolutely no intent of going to college, pursuing her GED or getting a job.

    My question is if this child now legally an adult has made all of these obvious poor choices why would I still be obligated to make further payments?

    Thanks for any input.

    Default Support of Ingrate Child

    Because that's what your divorce judgment and custody order provide?

    Consider filing a motion to terminate your support obligation, particularly if she's living "independently" (for lack of a better word).

    Default Child Support

    She isn't living independently, she is living at home with her father, but doing nothing. Unfortunately I don't have copies of my divorce or the documentation for the support so it may or may not stipulate when the payments cease.

    Also, is the rationale for age 21 due to the hopes of most children continuing their education for another 4 years, which I am in complete agreement with but my daughter is doing absolutely nothing. Can I research NYS websites for paperwork regarding the termination and if so is it necessary to hire an attorney etc......

    You can get a copy of the original agreement in the county and state where it was finalized.
