    Exclamation Michigan Hyta Closed to Public, but Was Open to Public

    My question involves civil rights in the State of michigan. i was sentenced under youthful trainee status, MCL 762.14. i read on that it stated on there unless guilty for csc. i was guilty for assult. "all proceedings regarding the dispostion of the criminal charge and the indivdual's assignment as youthful trainee shall be closed to public inspection" i had a job do a background check and on there it said i was found guilty and it was a felony class, and this was open to the public to veiw, courts said it was sealed on there part but the state poilce enterd it in. and everything was way wrong. and the public could view this.

    If you were applying for a job that has anything to do with the government, it is open for viewing

    (4) Unless the court enters a judgment of conviction against the individual for the criminal offense under section 12 of this chapter, all proceedings regarding the disposition of the criminal charge and the individual's assignment as youthful trainee shall be closed to public inspection, but shall be open to the courts of this state, the department of corrections, the family independence agency, law enforcement personnel and, beginning January 1, 2005, prosecuting attorneys for use only in the performance of their duties.

    I can think of several things that could have happened, including the employer being exempted as described above, the record showing the arrest and charge but not the disposition (and your employer inferring the rest), there being an error in the abstracting of the charge, your being discharged from HYTA as a violator and thus having a conviction entered, your having been sent to a DOC bootcamp (or something similar) with that record being detected....

    Your official criminal record shouldn't indicate that you were "found guilty" unless a conviction was entered, and that shouldn't happen under HYTA unless you violate your probation.

    yeah i never violated my probation the courts says it was an error and i wasnt applying for a gov job just a reg factor job. anything i could do since i lost the job becuase of this and now its not on a criminal back ground check
