My question involves criminal law for the state of: Ohio

My fiance is currently incarcerated for an F4 on Receiving Stolen Property. We went through trial and they gave him 9 months. My question is that by this charge, he got a probation violation for his prior record. He got 4 years prison on an F1, which I believe was the theft charge. He served 22 months and got out on judicial release. The rest was community control/probation. He had been out for over a year with no other violations. I keep hearing that he can get up to 5 years because they can make all the probation/comm control prison time if they so choose. I was wondering what kind of sentence we should be expecting. 5 years sounds a little extreme for a first time violator to me. Any ideas would be greatly appreciated. He is halfway through his 9 months and still havn't found out what is going on with this!
