    Default Right to Partition

    My question involves real estate located in the State of: Massachusetts

    I am a beneficiary of a trust which holds title to a house. If I want to sell the house, would I be able to successfully sue for partition even though I am only a beneficiary of the trust, and not an actual owner?

    If you are merely a beneficiary of the trust that owns the house, you do not have any ownership interest to sell or partition. You're not an owner or co-owner. Your rights are defined by the trust.
