    Default Suing Landlords for Deposit

    My question involves a security deposit in the State of: Kentucky

    Well, I posted a while back about my situation. My fiance went back to our old rental and the current tenants let him in and he videotaped and took pictures of everything that the landlords supposedly "fixed" but actually they really didn't. So they lied. Also the current tenants are having the same problems we did with the landlords. They still have a raccoon infestation which is dangerous because the house runs on gas and I'm sure there are gas lines underneath and other wires and cables. Their pilot light goes out about two to four times a day, which means no heat. There is mold growing up the wall in the bathroom and bedroom as there was when we lived there. So my question is, is it possible to sue the landlords to recover our full deposit based on not having the security deposit in a seperate account, not fixing the supposed damages, and not providing a safe and habitable living conditions? Also, would it be possible to recover interest or even our rent from every month we lived there since there was carbon monoxide and other hazardous conditions? And another question, the current tenant asked us if we would start a petition against the landlords as the other tenants in the community had alot of horror stories as well. Would this work to get new management since the landlord is so corrupt?
    I've already written to the better business bureau but I haven't heard anything back for two weeks. So I am sending a letter demanding our deposit back and I'm going to send it certified mail with a return receipt and Im giving them fourteen days to respond...is this the next step to take?

    If you believe your landlord has withheld money that is supposed to be refunded, you can sue in small claims court.

    I have no idea what you would hope to accomplish with a petition, or who you intend to give it to.
