I received a traffic ticket via mail. Attached letter stated that on 12/14 a person (not disclosed) reported that I passed a school bus while it was discharging students. Under statements at the bottom it said, "White male, twenties". I pled not guilty at arraignment and explained to prosecutor that I was actually quite ill on 12/14, 15 and 16. That the vehicle was a company vehicle (I own my own business) and that on that day two other people were using the vehicle. He implied that the bus driver could identify me. I am terrified as I have been designated a habitual offender (I forgot to pay for a ticket and my license was suspended and I did not know it). Despite the number of people who can testify on my behalf I fear that the driver will guess which one of us it is, and make a mistake. If I am found guilty I will lose my license for one year and possibly face a short jail sentence.
How common is it for a citizen to tell police they witnessed something and claim to be able to make a positive ID? Given the brevity of the description I must assume this person did not get a good look at the driver. Should I obtain an attorney?
