    Question Accused of Theft

    My question involves criminal law for the state of: Arizona.
    I have been accused of stealing a computer from my place of employment. The facts are: I was assigned 4 laptop computers, 3 were over 10 years old and one was new. When I left my position, I returned the 3 old computers, one of which was broken. The replacement cost of a comparable computer, 10 years old, is approximately $300. The new computer, valued at $1200, I agreed to purchase. The business manager withheld $1500 from my last paycheck. However, she is stating that I still owe them $1000. She is attempting to charge me $1200 for the 10 year old computer. Is this legal? If I have paid for the computer which I kept, is their report of "theft" a false report? Is there a way to handle this without hiring a lawyer? Thanks for taking the time to read this.

    Thank you so very much. However, I was actually asking for additional information... such as if there is a way to handle this without hiring a lawyer.... and was hoping for specific places to find the laws stating that they can't expect to get full price for a 10 yr old computer.... and that they can't legally take money from my paycheck to pay for anything. Oh, well, I guess I will need to look elsewhere for further assistance. Thanks again.

    If they haven't tried to prosecute you by now, and they helped themselves to a chunk of money when you left your job, odds are that if they tried to file charges the police will tell them that it's a civil matter.

    If you want to settle their claim, negotiate and pay off the agreed amount. If you can't reach an agreement or don't want to, nothing is stopping you from cutting off communications and seeing if they sue you. Your defenses if they sue you? They were discussed in the prior thread.
