    Default What Happens if Your Income is Cut in Half

    My question involves child support in the State of: Michigan

    I posted this last night and because of the title it was moves to the debate area, I have additional questions and I do not know how to move it back to child support.


    I work n the auto industry and now that the auto industry bailout was declined there is a good chance my wage will be cut. What happens if they force the workers to cut their income in half? I am assuming that this is not considered a voluntary pay cut, and that in this economy they are not expecting the parent to find another job making $30 plus dollars an hour?

    So.... are they going to base the child support off of the new wage? Also now that they take the children born secondary into account, how is that going to work. I understand that people say you shouldn't have more kids if you can't afford them, but a worker that get's their wage cut in half could not have anticipated this was going to happen when the big 3 were doing well.

    Basically the question is can there be a reduction of child support if the wage is cut in half and what about new children?

    Here is the reply in debate area, may be before it was moved:

    Child support is based on tables of income under state law, if you have reduced income, the man or woman paying CS can ask a court to modify such, yes. You can't pay what you don't have.


    My reply:
    The reason why I want to know is because I have seen posts that the courts require the NCP to still maintain child support at the amount that they did before because they are capable of earning that much. The only reason that I am capable of earning that much is because that is what the auto industry pays, even if I went back to college to get a degree I doubt that I will ever come any where close to that pay amount again. I am not being underemployed, there is not just a job paying that much out there.

    Additional questions:

    The place I work out offers buy outs. One is around $100,000 before taxes and I walk away from the job. The second is go to school and recieve 85% of my pay then walk away.

    How does this work for child support? If I take the $100,000 which ends up around $60,000 after taxes will they raise my child support even though I do not have any arrearages? What about with going back to school and having my income cut down?

    I am looking at my options because I think at some point they are going to cut the auto jobs in half and that is not much to live on for all the years I have been there.

    Not true. Go back and become a nurse. Not a town around without a shortage. You can also make that and more if you want overtime.

    The government is well aware that the big 3 empolyees are quite overpaid....that's the main reason the bail out was rejected. I mean no offense.

    Your hands down best option is going to be the 85%. With an education, your chances of gainful employment increase and your pay has the potential to increase.

    Your CS is still caculated as per the above posts.

    I think it will be more than half of the jobs cut.

    I looked into going back to school to be a nurse or something like that but the class is 3 years long and there is no guarantee that you will get into the actual nursing program after you complete the first year of pre-req classes. If I take the school option I can only go to school for 2 years, that leaves me with 1 year with out pay or a degree.

    What happens if I take the flat out money, and then stretch it out and get a lower paying job at night, how will they do the child support with the buy out money?

    I am just worried that the FOC will expect me to get a second job to pay for the current amount of support which is a lot, there is no way I can make half my wage and keep that up. If I go back to college I don't see how I can work full time, part time, and go to school full time.
