    Default Employer Forces Spousal Health Insurance in Order to Maintain Employee Coverage

    My question involves labor and employment law for the state of: Michigan
    My employer states that if my spouse is offered health insurance at her job, she must enroll regardless of the cost. Is this legal?

    If what your employer is saying is that if your spouse has access to health insurance through her own employment she is not eligible through yours, yes, that is not only legal, but becoming fairly common as insurance costs skyrocket.

    Legally, your employer is not obligated to provid health insurance to you at all. He is certainly not obligated to provide it to non-employees who have access to it elsewhere.

    Let me clarify. I pay an extra amount to insure my wife through my employer. My employer is telling me that she must enroll regardless of the cost. She would have to quit her job because it is part-time and the premiums she would have to pay would not make it cost effective for her to keep working. If she quits, my employer will still cover her. Does this make any sense at all?

    I'm not saying it makes sense. I am saying it is legal.

    More and more employers are refusing to cover dependents who have access to other health coverage. There is no law that says they cannot so refuse; therefore it is legal.
