My question involves name change laws in the State of: NY
When my son was born I gave him his father's last name, because I believed we would be married someday and I would share that last name as well. When my son was nine months old, my ex was very abusive one night and I kicked him out. About 5 months later, he broke into my home and tried to kill me. I was able to fight him off and dial 911 and he was arrested. I have an order of protection against him, but the judge took my son off of it in case my ex wants to go to court to see him. He has not...this is over 2 years later. He does send child support every month. I have since had another baby, and she has my last name. I want us all to have the same last name, but also I feel it would be better for my son since he is not growing up around any of his father's family, and I don't really want him to associate himself as his father's son. (while in jail he was on suicide watch, put on prozac, and even admitted to planning a suicide-by-cop and made a weapon in his cell to attack a guard with, but never used...so he's clearly not mentally healthy) What is the best way to try to give my son my last name, and what are my chances? Thank you!
